Terms and Conditions
1 Letting Period
Holiday lets will be for periods not less than one week and normally from Saturday to Saturday unless otherwise agreed and it will be available from 16:00 on the day of arrival and must be vacated by 11:00 on the day of departure unless otherwise agreed by us.
2 Booking
2.1 Deposit
The deposit is the initial payment made in order to secure a booking and will be 30% of the total booking price to the nearest ten pounds. The deposit must be sent to us together with the booking request form provided that it is more than 56 days away from the beginning of the holiday.
2.2 Balance
The balance is the remainder of the letting cost to be paid at least 56 days before the first day of the holiday. It follows therefore that if a booking is made 56 days or less before the first day of the holiday then the balance and the deposit must be paid together.
2.3 Procedure
- Complete booking form and return with deposit cheque
- Receive booking confirmation
- Receive Balance Reminder 56+ days before the balance is due
- Pay the balance plus damage deposit amount
- Receive directions to the casa and contact information
3 Payment
Currently payment can be made by cheque in either Sterling or Euros. Cheques should be sent complete with booking form to: D. J. Allen, 73, Goldsmid Road, Tonbridge, Kent. TN92BU. England.
4 Amendments
If one of your party is unable to travel you may transfer the place to another person provided that you notify us in writing (email is sufficient) of the details of the change and confirm that the replacement person has also read and agreed these terms and conditions.
Additional persons may be accepted provided that the total numbers do not exceed the capacity of the casa provided that the preceding paragraph is complied with and the per-person additional charge is paid at the time of such notification.
You do not need to notify us in advance if fewer persons are going to travel then booked on the form.
Provided it is possible to accommodate you may change the dates of your holiday after the booking has been agreed provided. Should those circumstances arise the holiday charge will not be less than that originally booked and the administration fee of £50.00 must be paid prior to the change being agreed.
5 Cancellation
5.1 By You
Unless otherwise agreed by us the deposit and/or the balance is not refundable. You should ensure that you have adequate holiday insurance to protect against unlikely events that may prevent you from travelling.
In the event that a cancellation by you can be re-booked then a refund will be made of at least a part of the payment and possibly all of it less an administrative charge of £25.00.
5.2 By Us
If we cancel your holiday because of a breach by you of these terms and conditions then no refund will be made.
If your chosen accommodation becomes unavailable an alternative will be offered if possible. Should you not accept the revised accommodation then a full refund will be made.
6 Arrival and Departure
6.1 Arrival
The casa will be available from 16:00 on the day of arrival but depending upon circumstances may be available earlier. Please check with your local contact or us should you need to gain entry earlier.
6.2 Departure
The casa must be vacated by 11:00 on the day of departure. It may be possible to depart later than that but deal with as in 6.1. Just prior to you departure the casa will be checked for damages and your deposit cheque returned or dealt with as in 7 below.
7 Care of Property
By accepting these conditions you agree to a duty of care with regard to the property and to pay for loss and/or damage for which you are responsible. You accept responsibility for any loss or damage caused to either the fabric of the building or fixtures and fittings as well as books CD’s and the like during your tenure of the property. Such a duty also extends to the driveway, poles or posts and other structures both natural and otherwise situated within the boundaries of the property.
You are obliged to report to us or our agents or any loss, damage or breakages that may happen.
The amount of the damage deposit will be detailed on the booking form. Just prior to your departure you are required to afford access to our agents for a premises inspection and when successfully completed we will return the damage deposit amount to you directly by BACS or cheque should you wich it to be done that way. Should there be a degree of damage as defined and embodied in this section (7) then:
- If the amount is known we will deduct the amount from the damage deposit held.
- If the amount is unknown then when it is known the appropriate amount will be deducted and the remainder returned to you as above.
- If such damage is over and above the amount of deposit made then we will retain the damage deposit and invoice you for the outstanding amount once that is known.
Your liability for damage for which you are responsible is not limited to the amount of the deposit cheque.
You will not be responsible for loss and/or damage caused by a third party where there is clear evidence that a third party was involved. In the extremely unlikely event that such an incident occurs it must be reported to the appropriate authorities and a confirmation of the report obtained for our scrutiny.
8 Care of Self
All reasonable precautions have been taken to ensure a safe and enjoyable holday yet you also have a duty of care to yourself and your party. You should be adequately insured against tripping, falling, slipping and other such unlikely but possible events. Holidays in Portugal act as agents for the property owners for promotional and administrative purposes only.
9 Brochure and Web Information
All the information contained on the web site or in any brochures or leaflets is intended to portray a truthful and honest representation. There may be occasions where descriptions or conditions may vary because changes may not yet have been promulgated through all the types of informational media available.
The contract is based upon the information included on the booking form.
10 Special Offers
The minimum letting fee is the equivalent of four persons. Special offers such as two for one offers are still bound by the minimum letting fee. Two for one offers are charged as follows:
- 10 persons charged as 5
- 9 persons charged as 5
- 8 persons charged as 4
- 7 persons charged as 4
- 6 persons charged as 4
- 5 persons charged as 4
